I don't guess I see any more danger in using that tool than any other. You have to firmly press the muzzle against your work piece.
Never seen a nail powder charge nail gun that the projectile was locked to the hammer Maybe the newer Hilti guns, but mine just uses a 27cal. blank and bails with plastic fins Put the cartridge in the chamber push the nail head in the muzzle depress muzzle hard against whatever you are mad at It will send a 2" nail through a 2x4 nailing it to 1/4" or 5/16" thick steel
The only reason why I can think of that might get that gun banned is the powder charge can catch fire with a lighter. The gun doesn't even have a trigger so It must set the charge off by rapid compression. the same as a diesel pile driver

Mine is 22 caliber. Separate nail and cartridge. I like because the cartridges are available in 5 different power levels. For different materials and thickness.
The cartridges also fit the “dummy launcher” I use to play with my dog as my old shoulder does not enjoy throwing and more. I have also used that launcher to shoot a string over the house to drag a harness rope over to work on the steep roof.
Don’t tell anyone this...but you can also use a 22cal air gum pellet in a bolt action rifle. Then use a low power cartridge to plink varmints out of the garden. It just makes a pffft sound much like my air rifle.

Frank what I am talking about is that DOE banned this type of nail driver for all their contractors because in one case the wrong powder load was used and a nail went thru a wall and stuck in a workers safety glasses...I know that there a lot of the type you have out there but they are unsafe if used wrong...also I have been retired 30 years but I think the rules are the same now...
