If the pilot was paying attention and knew where his aircraft really was, he could have gone upward a few more feet and avoid the attack - and especially the boot to its throat in the end.

It has to do with field of view. The operator was not able to see them below as the camera was facing forward. That drone is GPS stabilized, so once he flew into position, it is pretty much going to stay in that spot unless he moves it.....or someone else does as they did.
