Not sure that he should have been, the responsibility of the ride rests on the operator as the truck was stationary and should have been observed.

The ride operator lowered the tower proton of the ride prematurely. If you look closely the ride is mounted on the platform of the truck. The passengers hit the storage area on the front of the trailer
