Not enough video to determine if the conductor kicked, or was hanging his foot out. The conductor might get a safety violation for not keeping hands and feet inside the car at all times until the ride comes to a complete stop.

Either way, the photographer needs to be arrested for trespassing and any other laws applying. This was intentional breaking of the law by the photographer.
